The issue of the origin of the genetic rights (which are also called as the innate, essential and natural rights) is among the most important issues about right. Today, there are many claims about human rights and his essential rights, such as the right to life and the right to freedom. The fate of various political issues in the field of human rights is connected to the origin of the so-called essential human rights. Assuming the intrinsic nature of some rights, the origin of such rights requires serious investigation. Does the human being possess some rights based on humanity? Is human dignity the origin of such rights? This article tries to establish that the origin of essential or genetic human rights is restricted to the genetic sovereignty of Allah Almighty. <p>معنای حق، چیستی حق، تلازم حق و تکلیف، انواع حق و منشأ حق برخی از مسائل مهم نظری در فلسفه حق است. مسئله «منشأ حق های تکوینی» (که از آن به حق های فطری، ذاتی و طبیعی نیز تعبیر می شود) یکی از مسائل مهم در مباحث مربوط به حق می باشد. امروزه ادعاهای بسیاری درباره حقوق بشر و حق های ذاتی مانند حق حیات و حق آزادی می شود. سرنوشت مباحث گوناگون سیاسی در حوزه مهم حقوق بشر، به حل مسئله منشأ حق های ذاتی ادعایی در حقوق بشر گره خورده است. با فرض قبول ذاتی بودن برخی حق ها، منشأ پیدایش چنین حق هایی نیازمند بررسی جدی است. آیا انسان از آن جهت که انسان است، حق هایی دارد؟ آیا کرامت انسان، منشأ حق های مذکور است؟ به نظر می رسد منشأ حق های ذاتی یا تکوینی بشر، منحصر در ملکیت تکوینی و خدای متعال است.</p> https://marefatfalsafi.nashriyat.ir/sites/marefatfalsafi.nashriyat.ir/files/article-files/7_15.pdf
